The man taken into custody Tuesday in connection with a fatal shooting that occurred late Monday evening in Roswell has been identified as the victim’s nephew.
Brandan Troy Berg, 31, is charged with first-degree murder, possession of a firearm by a felon, unlawful taking of a motor vehicle, and criminal solicitation to commit tampering with evidence.
Berg was taken into custody as a potential suspect at around midnight Tuesday, shortly after the shooting occurred. He remained in custody – with a portion of that time spent in a local hospital being treated for injuries suffered during a physical confrontation with a group of other men after allegedly fleeing the shooting scene – until being formally arrested in connection with the murder Tuesday afternoon.
Berg was booked into the Chaves County Detention Center on a $250,000 bond.
Police were dispatched around 11:55 p.m. Monday to a home in the 1500 block of North Pontiac Drive in Roswell. Inside, they found Edward L. Pyeatt, 61, shot multiple times. Pyeatt was transported to a local hospital, where he died less than a half-hour later.
A few minutes before Pyeatt was pronounced dead, Roswell police and Chaves County Sheriff’s Office deputies responded to a call of an intoxicated person causing trouble outside a business in the 300 block of East McGaffey Street in southeast Roswell.
Three men reported encountering Berg, whom they said was armed with a handgun they forcibly took away from him. Police took possession of the gun, and a car Berg was allegedly driving was also recovered nearby. The car is believed to have been stolen.
Berg was taken to the hospital by a CCSO deputy. There, Roswell police took custody of Berg, who was held on a probation violation prior to being charged with murder.
A witness in the North Pontiac area when the shooting occurred told police he saw a car drive to the victim’s house, and a male subject exit the car and run to the front door of the home. The witness said he then heard multiple gunshots and saw the male subject return to the car and drive away.
A family member who was in the house at the time of the shooting told police a man walked in and shot Pyeatt. That witness said she did not know the shooter’s name.
