Five years after the death of 4-month-old Kalynne Flores, the case against Robert Flores, 28, originally of Artesia, is headed back to trial this morning.
On Dec. 6, 2007, Flores’ daughter, Kalynne, was found unresponsive in a laundry basket inside a closet by her mother after she returned home from work at 3:30 a.m. It was determined by a medical investigator that Kalynne’s cause of death was asphyxia.

In an interview with the police a few hours later, Flores stated, according to the New Mexico Court of Appeals, “that he had been drinking and that, around 10:45 p.m., had placed Kalynne in a laundry basket in the closet and left to go buy beer and cigarettes.”
Flores is charged with intentional child abuse resulting in death, abuse or abandonment of a child, and two counts of tampering with evidence. He has pleaded not guilty. Flores could be sentenced to life in prison if found guilty, as intentional child abuse resulting in death is a first-degree felony in New Mexico due to Brianna’s Law.
