Artesia Police Department officers were dispatched just after midnight Monday to the 900 block of Bullock Court in reference to an armed subject.
In the 800 block of Bullock Avenue, officers made contact with Timothy Hoerath of Artesia. He denied having been involved in the incident, but after officers detected a strong odor of alcohol, Hoerath reportedly admitted to having drunk a six-pack of tall boys. Officers transported him to the 900 block of Bullock Court for further investigation.
There, the reporting party informed them Hoerath was his mother’s ex-husband and had arrived at the apartment in an intoxicated state. According to the police report, the man told police he had gone outside to speak to Hoerath, who had stated he “was going to kill somebody.” The man said he was unaware to whom he was referring.
The man said Hoerath then pulled a knife out of his pocket, at which point the man told him to leave and reentered the apartment. He said as he was retrieving his phone to call the police, Hoerath banged on the door, then kicked it in.
As the door flew open, the man’s pit bull attacked, biting Hoerath and causing him to drop his knife. The dog continued to pursue Hoerath, who attempted to hide behind a vehicle but was bitten again on the leg. The reporting party at that point subdued his pit bull, and Hoerath walked away from the residence.
Police spoke with two witnesses inside who confirmed the story, and the reporting party directed officers to a black-handled kitchen knife on the ground where Hoerath had dropped it.
Officers also observed the apartment’s front door frame was broken, with the deadbolt still in the locked position.
Hoerath was arrested on charges of attempted breaking and entering, criminal damage to property (less than $1,000), and aggravated assault. He was transported to Artesia General Hospital for treatment of his dog bites.
Hoerath is scheduled for a Sept. 13 preliminary examination in Artesia Magistrate Court.
