A preliminary hearing date has been set for a Carlsbad man charged with murder in a death that occurred last week.

The incident occurred Oct. 30. Eddy County Sheriff’s Office deputies responded to the scene of a vehicle fire on Capitan Reef Road near the Pecos River and, upon arrival, discovered a male unconscious and not breathing near the riverbank.

The investigation determined the male, later identified as Fred Harris, 44, of Carlsbad, had died at the scene.

Further investigation led to the arrest of Austin Madrid, 22, of Carlsbad, who was charged with an open count of murder and tampering with evidence.

Madrid is scheduled to appear for preliminary examination at 9 a.m. Nov. 16 in Carlsbad Magistrate Court.
