Bobby P. Smith of Artesia has been bound over to district court for trial on an open count of murder in the first degree in connection with the 2012 shooting death of a local security guard.

Smith, 24, was arrested Aug. 19 and charged with the murder of Michael Evans, 24. He was bound over to Fifth Judicial District Court in Carlsbad last week in Artesia Magistrate Court.

Smith stands accused of shooting Evans in the head and left arm with a .410-caliber revolver on the evening of Jan. 29, 2012, in the 100 block alleyway between Fourth and Fifth streets. He was originally taken into custody in early February 2012 and was previously housed in a criminal/medical evaluation facility while competency was determined.

Smith also faces charges of shooting at or from a motor vehicle, tampering with evidence, and receiving stolen property (firearm).
